Course details
The Arbitration and legal analysis of Islamic financial contracts course provides a comprehensive understanding of arbitration for selected Islamic financial contracts and its legal analysis. The course highlights to participants the importance of Shariah standards and explains its relationship with civil law. Legal implications and issues that may arise from certain procedures is also covered together with its mitigation alternatives. Two Islamic finance modes are scrutinised: Murabahah to the purchase orderer and Ijarah Muntahia Bittmaleek.
Learning Outcomes
On successful completion of this course, participants will be able to:
- Explain the essentials of two of the most widely uses modes in Islamic finance
- Infer laws taken from the AAOIFI Shariah standards and contrast them with the civil law that are tied to the Islamic modes of finance discussed
- Analyse the practical aspects of the Islamic finance modes discussed and evaluate them from a legal perspective
- Discuss specific issues related to the legal aspects of Islamic finanical transcations? such as the problems that relate to the translation of such contracts from Arabic to English and find a solution

This course is for inpiduals that come from and may not be limited to: the legal department of Islamic banks, leasing and financing companies, practitioners who work in the finance and investment departments of Islamic banks, staff of leasing and financing companies, practitioners who work in various investment funds, lawyers and experts, students of law and finance, members of the Shariah supervisory boards and Shariah audit.
