The Independent Accountant’s Report for Examinerships

Speaker: MicheálLeyden, Kavanagh Fennell

Examinerships are a highly effective corporate restructuring tool when the conditions are correct. legislation was published to permit Circuit Court Examinership for small and medium sized businesses with enactment expected early in 2014.  This new legislation will finally open up this restructuring solution to companies where liquidation would otherwise be inevitable.

This presentation will aid accountants in practice to identify clients or takeover targets suitable for the process and aid the accountant in completing the Independent Accountant’s Report which forms a vital element of the initial application for Court Protection and Examinership.

Informal Debt Restructuring and the Personal Insolvency Act

finally saw the Insolvency Service of Ireland “ISI” open its doors for applications.  The ISI in the making since the last update to Irish personal insolvency laws in 1988.  The Personal Insolvency Act is part of the longer term stabilisation of the country’s finances and is a very substantial improvement to its 1988 predecessor.   Significant increases in application numbers must be expected year on year.

This presentation will provide assistance to accountants in practice to identify clients suitable for a personal insolvency process, review informal debt restructuring / negotiation options and advise clients on the benefits and risks of pursuing personal insolvency or an informal approach.
