Course details
This Diploma has been specifically designed for professionals working in the financial services sector. The Diploma delivers theoretical and practical training in dispute resolution processes with a particular emphasis on negotiation, facilitation and mediation for financial services disputes including debt re-structuring. The Diploma will also provide students with a comprehensive overview of the implications of the Personal Insolvency Act 2012 and the Mortgage Arrears and Resolution Process. The Diploma is designed to teach candidates how to negotiate effectively to resolve disputes as well as creating solutions providing for mutual gains for both parties. The teachings are derived from the Harvard Negotiation Project. The Diploma will also focus on how to effectively handle difficult conversations, managing emotion in financial disputes and how to overcome impasse in negotiations. The Diploma will also teach students the stages in a mediation process, recent mediation developments which are relevant for the financial services sector and how to best prepare for mediation. The practical based course will be highly interactive, with a joint emphasis on negotiation and mediation theory and practical skills which are relative particularly in relation to the Personal Insolvency Act 2012 and the Mortgage Arrears and Resolution Process. Students will engage in a series of hands-on simulations, ranging from two-party encounters to complex multi-party scenarios.
Module 1: Recent Developments in the Financial Services Sector (Week 1-3)
- A comprehensive review of the Personal Insolvency Act 2012 and the implications for the borrower and creditor under the Insolvency Service of Ireland
- A comprehensive review of the role and responsibilities of the Personal Insolvency Practitioner
- A comprehensive review of the Mortgage Arrears and Resolution Process
- A comprehensive review of the emerging role for dispute resolution processes in the financial services sector
Module 2: Advanced Negotiation Skills for the Professional (Week 4-8)

Module 3: The Emerging Role of Mediation in the Financial Services Sector (Week 9-12)
- Comprehensive review of the Mediation Bill 2012

- How to Effectively Prepare for Mediation
- Key Mediator Skills: reframing, questioning, listening, reality-testing, assisting negotiation
- The Role for Mediation in the Financial Services Sector
