What is this course about?
The aim of this module is to introduce the student to the fundamental concepts and laws of evidence in Ireland.
This course is an ECTS 10 credit module of the BA (Honours) in Law Degree.
On completion of this course, students should be able to:
- Possess a thorough and applied knowledge of the basic concepts of evidence and of the terminology used;
- Analyse and distinguish between the various standards of evidential proof required and comprehend and appreciate the importance of such distinctions;
- Have a command of the witness system, of the competence and compellability of witnesses and of the course of evidence;
- Demonstrate in-depth knowledge of the rules regarding identifi cation and confession evidence;
- Identify when evidence is improperly obtained and analyse the legal status of such evidence;
- Assess and evaluate the impact of the various privileges and immunities upon evidence and will be able to discuss the approach of the courts to such privileges and immunities;
- Fully understand the rule against selfi ncrimination and of the rule against hearsay and will be able to evaluate the impact of these rules upon the law of evidence.
