What is this course about?

The overall aim of this course is to give students a thorough understanding of the fundamental principles of Administrative Law in Ireland. It will provide the student with an in-depth examination of the rules which regulate the conduct of an administrative body as well as the principal remedies available for the correction of a breach of those rules

This course is an ECTS 10 credit module of the Law degree.

On completion of this course, students should be able to:

  • Discuss and evaluate the main grounds upon which the acts of public bodies may be challenged on judicial review;
  • Have an ability to demonstrate a coherent and detailed knowledge of the doctrines of bias; fair procedures; judicial review for factual error; errorof law; the rule against unlawful delegation; the proportionality doctrine; the law of legitimate expectations; and the unreasonableness doctrine;
  • Demonstrate a detailed knowledge of the remedy of judicial review;
  • Demonstrate a detailed knowledge of the principal elements of the torts of malfeasance in public office; of negligence in the exercise of public power; of breach of statutory duty and also of the procedure regulating an application for habeas corpus under Article 40. 4.2 of the Constitution;
  • Have the ability to independently research and analyse various aspects of administrative law and present their findings. The student will be able to interpret and apply the knowledge gained to formulate solutions to case studies involving administrative law.

What are the minimum entry requirements?

All applicants will be considered on a case-bycase basis. Lifelong Learning reserves the right to require applicants to attend for an interview to determine their suitability for the programme.
