Course details

The day-long course aims to be a refresher for those more experienced personnel and an introduction to the relevant areas of law for those with little or no prior media law training or education. The courses provided by Andrea Martin / MediaLawyer have always featured a high level of trainee interaction with the course facilitator and time has been allowed for this to take place.

Training Content

The course will cover the following content:

Areas of law relevant to programme output and associated social media output:

  • Defamation – review of basic principles of defamation law, update since introduction of Defamation Act, 2009, review of recent defamation cases, practical tips for risk management.
  • Social media – copyright, notice and take down procedures, disclaimers for content, hyperlinks and deep-linking.
  • Privacy and data protection – constitutional right to privacy, Article 8 rights under European Convention on Human Rights, case law on privacy, basic principles of data protection, practical data management tips.
  • Broadcast Regulation and BAI Codes – structure and role of BAI, role and processes of Compliance Committee, statutory basis for Codes, Codes – particular reference to Fairness Code and Election / Referendum Codes.
  • Court Reporting and Contempt of Court – legal basis for court reporting restrictions, common law and statutory, reporting cases involving children, reporting sex crime cases, sub judice rule and managing contempt risk in reporting.

Training Method

The course can be delivered on a modular basis and can therefore facilitate the half day release of personnel, where full day release to attend the entirety of the course is not feasible. Over the course of x2 half day attendances, personnel would have attended the entirety of the course.
